James 22 SMS/Mobile Messaging Program Terms & Conditions

James 22 (“we,” “us,” “our”) offers a mobile messaging program (the “Program”) that allows you to receive recurring SMS and/or MMS text messages (collectively, “Messages”) on your mobile device. These Messages may include promotional content, marketing offers, updates, alerts, reminders, transactional information, and other communications related to our products, services, events, promotions, and customer support.

By opting in to the Program (e.g., by submitting your mobile number on our website, texting a keyword to our short code or long code, checking a consent box, or otherwise providing affirmative consent), you expressly agree to receive Messages from us using an automatic telephone dialing system, artificial/pre-recorded voice, or other automated technology, at the mobile telephone number you provided. You also agree to be bound by these Mobile Messaging Terms & Conditions (these “Terms”), our general Terms of Service, and our Privacy Policy.

1. Consent & Opt-In

Consent to receive marketing Messages is not a condition of any purchase. You can opt in by:

 

Entering your mobile number and agreeing on our website form;

Texting a keyword (e.g., JOIN, YES, START) to our short code/long code; or

Other methods we may offer from time to time.

 

By providing your mobile number and consenting, you represent that you are the account holder or authorized user of that number and are at least 18 years old (or the age of majority in your jurisdiction).

2. Message Frequency & Content

Message frequency varies and may be recurring (e.g., several per week or month). We reserve the right to change the frequency at any time without notice. Examples of Messages include promotions, discounts, product updates, cart reminders, appointment confirmations/reminders, and account notifications. Message and data rates may apply.

3. Opt-Out & Cancellation

You may opt out of the Program (and stop receiving Messages) at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any Message you receive from us.

After opting out, you will receive one final confirmation Message verifying that you have been unsubscribed. Following that, you will no longer receive Messages (though standard messaging rates may still apply during the process).

4. Supported Carriers & Delivery

The Program is supported by major U.S. carriers (including but not limited to AT&T, Verizon, T-Mobile, Sprint, and others). Delivery is not guaranteed, and we are not liable for delayed or undelivered Messages due to carrier issues, network problems, or other factors beyond our control.

5. Costs & Responsibility

You are responsible for all charges from your wireless carrier associated with receiving our Messages (including standard messaging, data, and other fees). We do not charge you for sending Messages, but your carrier's rates apply.

6. Changes to the Program

We may modify, suspend, or terminate the Program (or any part of it) at any time without notice. We may also update these Terms from time to time; continued participation after changes constitutes acceptance of the updated Terms.

7. Limitation of Liability & Disclaimer

To the fullest extent permitted by law, we disclaim all warranties (express or implied) regarding the Program. We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your participation in the Program, even if advised of the possibility of such damages.

8. Dispute Resolution

Any disputes related to these Terms or the Program will be resolved in accordance with our general [Terms of Service] (including any arbitration clause therein).
